Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and SingularX (“we,” “us,” “our”), the operator of the Malaya app (“Malaya” or the “app”). By creating an account or using Malaya, you agree to these Terms. If you don’t agree, please don’t use the app.

Who can use Malaya

You must be at least 18 years old to use Malaya. By using it, you confirm that you are 18 or older and able to enter into this agreement.

What Malaya is

Malaya is a nutrition and wellness app for tracking food, calories, macros, water, fasting, activity, weight, and mood, with optional AI features that estimate nutrition from a photo or a description. It is a tool to help you stay aware of your habits — nothing more, nothing less.

Malaya is not medical advice

Malaya is for general wellness and informational purposes only. It is not a medical device, and it does not provide medical, nutritional, or professional advice, diagnosis, or treatment.

• The calorie and macro targets Malaya calculates are estimates based on general formulas, not personalized medical guidance.
• The AI meal scan and other AI features produce approximations that may be inaccurate. Don’t rely on them for medical decisions.
• Always consult a qualified doctor or dietitian before making significant changes to your diet, exercise, or health routine — especially if you have a medical condition.
• If you are struggling with, or at risk of, an eating disorder or any mental-health condition, please seek help from a qualified professional. Malaya is not a treatment tool.

You use Malaya at your own discretion and are responsible for your own health decisions.

Your account

You’re responsible for keeping your login details secure and for the activity that happens under your account. Please give accurate information when you sign up, and let us know if you think someone else is using your account.

Acceptable use

Please use Malaya honestly and legally. Don’t:

• break the law or use the app to harm others;
• try to access other people’s accounts or data;
• reverse-engineer, copy, or resell the app;
• overload, disrupt, or abuse our systems or AI features, including automated or scripted use.

We may suspend or close accounts that misuse the app.

Your content

Everything you log — your meals, journal, and other entries — belongs to you. By using Malaya, you give us permission to store and process that content only to run the app for you, such as saving your logs or generating an AI estimate. We don’t claim ownership of your content, and we don’t use it to advertise to you.

AI features

Malaya’s AI features rely on a third-party provider and are offered “as is.” They generate estimates that can be wrong, and they may occasionally be unavailable. Treat them as a convenience, not a source of truth — use your own judgment and edit anything that looks off.

Paid plans and billing

Malaya is free to use, with an optional Premium plan that unlocks additional features.

• Premium is offered as a subscription through the Apple App Store, and payment is charged to your Apple ID.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
• You manage or cancel your subscription in your Apple App Store account settings, not inside Malaya.
• Prices may change. We’ll give notice of any change, and it won’t affect a period you’ve already paid for.
• Purchases and refunds are handled by Apple under Apple’s terms and policies.

Our intellectual property

Malaya — including its name, design, logo, and software — belongs to SingularX and is protected by intellectual-property laws. These Terms don’t give you the right to use our branding or copy the app.

Ending your use

You can stop using Malaya anytime and delete your account from Settings. We may suspend or end your access if you break these Terms or misuse the app. If your account is closed, the parts of these Terms that should reasonably survive — such as the disclaimers and liability limits — still apply.

Disclaimers and limitation of liability

Malaya is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We don’t guarantee that the app will be accurate, uninterrupted, or error-free.

To the fullest extent allowed by law, SingularX is not liable for any indirect, incidental, or consequential damages arising from your use of Malaya, and our total liability is limited to the amount you paid us, if any, in the 12 months before the claim.

Changes to these terms

We may update these Terms as the app evolves. When we make significant changes, we’ll update the date at the top and let you know. Continuing to use Malaya after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. Any disputes will be handled in the courts located in Indiana, unless the law requires otherwise.
